Why Is Online Poker Banned



can my bank return a check if it has already cleared?

i recently received a check from an online poker site, so it’s legit and all. after the check was sent out, i also received an email from the poker site that they’re banning my account. why? they wont say, and i know damn well i haven’t done anything illegal. anyway, i deposited the check, and like most banks now i have to wait for the check to “clear.” i made the deposit on 4/14/08 and 3 days later, it cleared and was in my account. i checked my account statement and it says the check was returned on 4/21/08. it’s been a week since i deposited the check, 3-4 days since it’s cleared thats why my bank credited my account, and now it’s been returned and i have return fee charge. it’s almost as if they refunded MY MONEY without my consent. if the money has made it to my account, is it legal for the bank to return the money? who can i talk to and how can i go about this? yeah i’d like to go to my bank and the poker site owners and do some butt kicking but thats out of the question.

Are you so sure that this is a legit site for video poker? The warning bells for me when I read your question is that they banned you account for no good reason. Why would they do this? Do you pay them to use the site and gamble? Because I can tell you that this is most likely a scam for your money. They cut you a check, sometimes asking for you to cash it and send them some funds from that check for “fees” “taxes” or x amount of reasons. Or they need to give you some kind of a payout since to gave them money, and this bids them more time for you to gamble and pay them more money.

I work for a financial institution. What they did was perfectly legal. What I think happened was that you deposited a check, and they placed a three day hold. Now, because the hold is released does not neccisarily mean that the check cleared the bank it is drawn off of. It sounds like your bank did not give it enough time of a hold to make sure the check would clear safe and sound. If it were me and I saw it was from a poker site, I would of put the hold on for at least 7 – 14 days. It is my opinion that the check did not clear in three days, the hold dropped. But the hold that the teller or ATM placed was not long enough to help you avoid a return check item fee. I would only do the butt kicking to the video poker people, because frankly you got screwed. Think about it, they banned your account and the check was no good, something is wrong here. Do not use that site anymore, it is a scam guaranteed. As far as your bank, I dont think they did anything wrong, they could not clear a check and than have it not clear on the same item. Call your bank and explain to them that they should have put a longer hold on the item to give it enough time to clear, and if they had done that you would have not been charged their return item fee. It worth a shot, but not a guarantee because you do hold responsibility for what you deposit in your account.
